On October 25, 2012, a special operations unit (SEK) from the State Criminal Police Office (LKA) in Hanover, during a nighttime operation in Rollshausen, Lower Saxony, forcibly entered the wrong apartment, tied the man up in bed, and severely traumatized the family. Due to fear, the family later had to leave the mistakenly entered apartment and no longer live in Rollshausen.
The investigation against the SEK officers responsible for the error, on suspicion of bodily harm in office, was initially discontinued by the Göttingen public prosecutor's office by order dated July 17, 2013. Following an appeal by the affected family, the investigation has now been reopened by order dated August 12, 2013.
"Apparently, the Göttingen public prosecutor's office is finally paying attention to the quite incriminating statements made by the local emergency services," said attorney Sven Adam, who filed the appeal on behalf of the family against the temporary suspension of the investigation. Initially, the investigation also included the local commander. However, this case was rightly discontinued. "The local emergency services and their commander bear absolutely no responsibility for the raid on the wrong apartment. On the contrary: The information about the apartment that was actually to be raided was correctly and unambiguously passed on to the SEK (Special Deployment Commando) that night," Adam concluded. After questioning previously unheard suspects and witnesses, the Göttingen public prosecutor's office must now decide again on the further course of the proceedings.
