The Kassel Administrative Court has temporarily halted the redistribution of refugees from the so-called "flower house" in Witzenhausen

With a total of six rulings issued today, the Kassel Administrative Court has temporarily halted the relocation of refugees from the so-called "Flower House" in Witzenhausen to other collective accommodations in Bad Sooden-Allendorf, Reichensachsen, and Witzenhausen in expedited administrative proceedings. The Werra-Meißner district (WMK) had previously sent relocation notices to all residents of the Flower House, distributing the refugees to other collective accommodations. The court has now confirmed the suspensive effect of the lawsuits against these relocations.

The Kassel Administrative Court criticized the decisions regarding the redistribution of funds, stating that they failed to demonstrate any exercise of discretion. "A decision free from errors of discretion requires that the affected individual be heard and given the opportunity to present their interests. These interests must then be considered in proportion to their weight and weighed against the options available to the municipality," the court stated regarding the key considerations behind the decisions.

“The residents of the Blumenhaus can now remain in their homes for the time being. The Werra-Meißner district would be well advised to consider the preservation of the Blumenhaus in the coming weeks, without prejudice,” stated attorney Sven Adam, representing the plaintiffs, regarding the court's decisions. “The Blumenhaus meets special requirements, particularly concerning the protection of women and families. The consideration of these concerns will be reviewed in subsequent legal proceedings,” Adam concluded.
