Who is eligible for legal aid?

The personal and economic requirements are met if legal aid would be granted for court proceedings without the applicant contributing to the costs.

In simpler terms: You will receive financial assistance if not enough of your net income remains after..

reasonable advertising expenses including travel expenses for commuting from home to work,
reasonable insurance premiums (liability, household, life, accident, etc.),
reasonable (proportional) rent including utilities,
reasonable loan repayments and interest payments,

as well as any other possible deductions in the individual case and the legal action does not appear frivolous.

Put even more simply: Do you have a monthly net income, after deducting the amounts mentioned above, of less than €432, or, if married, less than €802 combined? Then you are probably entitled to legal aid with regard to your income.

This will likely apply in the vast majority of cases to recipients of benefits under the German Social Code, Book II (SGB II) (so-called ALG II), and especially to recipients of benefits under the German Social Code, Book XII (SGB XII) (assistance for living expenses and social welfare)!
