Accommodation costs in the social welfare sector for Gieboldehausen
Adequacy limits for housing costs within the meaning of Section 22 Paragraph 1 Sentence 1 of the German Social Code, Book II (SGB II) and Section 35 Paragraphs 1 and 2 of the German Social Code, Book XII (SGB XII)
The expert opinion commissioned by the Göttingen district from the firm A+K in March 2013 the social welfare system was deemed inconclusive by the Hildesheim Social Court in several main proceedings in February and March 2017, in accordance with the jurisprudence of the Federal Social Court. Therefore, pending the preparation of a new expert opinion and subject to the finality of the judgments already rendered, the Hildesheim Social Court will, until further notice, apply the values from Section 12 of the Housing Benefit Act (WoGG ) plus a 10% safety margin to determine reasonable limits for basic income support benefits within the jurisdiction of the Göttingen district, in accordance with the jurisprudence of the Federal Social Court, in cases of data collection failures by social welfare agencies.
The Social Court therefore currently (as of March 2017) considers the following values for accommodation costs (basic rent and cold utility costs – excluding heating costs) to be appropriate for Gieboldehausen:
