Anyone who, due to their personal and economic circumstances, cannot afford the costs of litigation, or can only afford them in part or in installments, is entitled to legal aid upon application, provided that the intended legal action or defense offers sufficient prospects of success and does not appear frivolous.” That is the law.

Who receives legal aid?

In very simplified terms, you can receive legal aid if not enough of your net income remains after..

reasonable advertising expenses including travel expenses for commuting from home to work,
reasonable insurance premiums (liability, household, life, accident, etc.),
reasonable (proportional) rent including utilities,
reasonable loan repayments and interest payments,

as well as any other possible deductions in the individual case and the legal action does not appear frivolous.

Put simply: If your monthly net income, after deducting the amounts mentioned above, is less than €432, or less than €802 for married couples, then you are likely entitled to full legal aid. If your income exceeds this threshold, you may still be eligible for legal aid in the form of installment payments.
