Regarding the criminal proceedings of the 25-year-old student who, on December 3, 2010, during a personal identity check on a regional train from Kassel to Frankfurt, allegedly felt reminded of "SS methods" without providing any explanation. In the proceedings, the student was initially convicted of insult and subsequently acquitted by a decision of the Higher Regional Court of Frankfurt am Main on March 20, 2012. The acquittal is final

The administrative court proceedings aimed at establishing the illegality of the aforementioned identity check and subsequent search on the regional train from Kassel to Frankfurt on December 3, 2010. The Koblenz Administrative Court initially declared the identity check lawful in a widely noted judgment of February 28, 2012. In press release no. 11/20120 of March 27, 2012, it was stated that the Federal Police could "select individuals to be approached based on their outward appearance." Ultimately, this was intended to legitimize so-called "ethnic profiling," which had already been declared a violation of human rights by the United Nations Human Rights Committee on August 17, 2009. By decision of 08.5.2012, the Higher Administrative Court of Rhineland-Palatinate has now admitted the appeal against the judgment of the Administrative Court of Koblenz and thus opened the way for a new round in the judicial review of “ethnic profiling” in Germany.
